Welcome to Prep & Palate. These Terms of Service (“Terms”) govern your use of our website and your purchase and use of our in-home personal chef and meal-prep services (collectively, “Services”). By accessing or using our website, or booking Services, you agree to be bound by these Terms.

1. Definitions

  • “Company,” “we,” “our,” or “Prep & Palate” refers to the business offering in-home meal prep and personal chef services.

  • “Client,” “you,” or “your” refers to any user, customer, or visitor who books or views our Services.

  • “Services” means the planning, grocery shopping, in-home meal preparation, cooking, cleanup, and any other related services offered by Prep & Palate.

  • “Site” refers to our website and any associated online platform, including mobile versions.

2. Acceptance of Terms

By accessing the Site or booking Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site or request Services.

3. Scope of Services

We agree to provide Services as requested by you. This may include:

  • Personalized menu planning based on your dietary preferences, restrictions, and nutritional goals.

  • Grocery shopping and sourcing of fresh ingredients.

  • Meal preparation and cooking in your home kitchen.

  • Packaging, storing, and labelling meals (if applicable).

  • Clean-up — returning the kitchen and cooking space to the condition it was prior to cooking.

  • Other related services as agreed upon during booking (e.g., meal portioning, reheating instructions).

4. Booking, Payment & Fees

  • All bookings must be made through our booking system or via agreed-upon contact channels (e.g., phone or email).

  • Payment terms, deposits (if any), and final payment amounts will be communicated at time of booking.

  • You agree to pay all fees associated with Services — including food costs, service fees, and any applicable taxes or charges.

  • Additional fees may apply for extra services (e.g., late cancellation, rush orders, special dietary requirements, extra cleanup, or extended cooking time).

  • We reserve the right to modify pricing, fees, or promotional offers at any time; however, any modifications will not affect confirmed bookings unless communicated to you with your consent.

5. Client Responsibilities & Home Requirements

To ensure safe, efficient, and smooth service delivery, you agree to:

  • Provide accurate information about dietary preferences, allergies, and any food restrictions at the time of booking.

  • Ensure that the kitchen and cooking area are clean, accessible, and meet basic health and safety requirements (e.g., working water, electricity, and sanitation).

  • Allow reasonable, uninterrupted access to the kitchen during the agreed cooking period. Remove pets, distractions, and potential hazards from the cooking area.

  • Secure valuables or fragile items before our chef’s arrival, and understand that we are not responsible for loss or damage of personal items if left unsecured.

If the kitchen is deemed unsuitable upon arrival (insufficient water or utilities, unsafe conditions, etc.), we reserve the right to cancel or pause service and/or charge applicable fees (for groceries purchased or time reserved).

6. Cancellation & Rescheduling Policy

  • Cancellations or rescheduling requests must be made in one day prior to the scheduled service.

  • If you cancel or reschedule after the allowed window, a cancellation fee may apply (including reimbursement for any groceries already purchased, and/or a service fee).

  • In cases of emergency (e.g., serious illness, unforeseen circumstances), we may — at our discretion — attempt to reschedule with your agreement.

  • By booking, you acknowledge that last-minute cancellations or failure to provide access may result in full or partial charges.

7. Food Safety, Allergies & Special Diets

  • We strive to use fresh ingredients and follow safe food-handling practices. All meals are prepared in your home kitchen and may be packaged with reheating or storage instructions where relevant.

  • We do not guarantee allergen-free meals unless explicitly agreed in writing and only based on information you provide. It is your responsibility to inform us of any allergies or restrictions.

  • You acknowledge that reheating, storage, or misuse of prepared meals (contrary to provided instructions) is your responsibility. Any adverse reactions or food spoilage arising from improper handling after meal delivery or service are not the liability of Prep & Palate.

8. Intellectual Property, Content & Use of Site

  • All content on the Site — including images, text, logos, designs, menu descriptions, recipes, and other materials — is owned by Prep & Palate or its licensors, and is protected by copyright, trademark, and other intellectual property laws.

  • You may not copy, reproduce, distribute, modify, or create derivative works of any part of the Site or content without our express prior written permission.

  • Booking Services does not grant you any ownership or license to our intellectual property.

9. Limitations of Liability & Disclaimer

  • To the maximum extent permitted by applicable law, Prep & Palate provides Services “as is” and “as available,” without any warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

  • Prep & Palate is not responsible for any indirect, incidental, special, or consequential damages, or loss of profits, goodwill, or data arising out of or related to your use of the Site or Services.

  • We are not liable for damages, loss, or injury resulting from user negligence, misuse of prepared food, failure to follow reheating/storage instructions, or improper kitchen conditions on your premises.

  • Our total liability to you for any damages arising out of or related to these Terms shall not exceed the amount you have paid us in the 12 months prior to the claim (or another cap as may be appropriate in your jurisdiction).

10. Modification of Terms

We reserve the right to change or update these Terms at any time. Changes will become effective upon posting the revised Terms on the Site. It is your responsibility to review the Terms periodically. Continued use of the Site or Services after changes constitutes your acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

These Terms and any disputes arising from them shall be governed by the laws of the State of Arizona, United States. Any disputes will be resolved in the appropriate courts of Maricopa County (or another appropriate venue in Arizona), unless we mutually agree to alternative dispute resolution methods (e.g., arbitration or mediation).

12. Severability & Waiver

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be severed from the remainder, which will continue in full force and effect. No waiver by Prep & Palate of any breach or default under these Terms shall be considered a waiver of any subsequent breach.
